These Terms of Service govern the use of staudj.shop and purchases made through the online store.

By accessing the website or placing an order, the user agrees to these Terms of Service, subject to all mandatory rights that cannot lawfully be excluded.

1. Seller and Contact

The online store operates under the trading name:

staudj.shop

Customer service email:

info@staudj.shop

The seller’s complete legal identity and geographic address must be displayed in the store’s Legal Notice.

2. Scope

These Terms apply to:

  • Use of the website;
  • Customer accounts;
  • Product enquiries;
  • Orders placed through the online store;
  • Contracts for the purchase of products;
  • Payments;
  • Deliveries;
  • Returns and refunds;
  • Customer communications.

Individual agreements expressly made with a customer take priority over these Terms.

3. Consumers and Traders

A consumer is a natural person who enters into a transaction predominantly for purposes outside their trade, business, or profession.

A trader is a natural or legal person, or a partnership with legal capacity, acting for purposes relating to their trade, business, or profession.

Certain provisions of these Terms apply specifically to consumers.

4. Eligibility

Customers must be legally capable of entering into a binding purchase contract.

By placing an order, the customer confirms that:

  • The information provided is accurate;
  • The customer is authorised to use the selected payment method;
  • The order is not being placed for fraudulent or unlawful purposes;
  • The customer will comply with applicable law.

5. Products

staudj.shop sells women’s fashion products, which may include:

  • Dresses;
  • Mini dresses;
  • Jeans;
  • Skirts;
  • Fitted trousers;
  • Tops;
  • Seasonal clothing;
  • Related fashion items.

The product description displayed when an order is placed forms part of the contractual product information.

Minor differences in colour may occur because of screen settings, lighting, photography, and manufacturing variations.

Measurements may vary within reasonable production tolerances. Customers should review the sizing information before ordering.

6. Product Availability

Products are subject to availability.

Placing a product in the shopping cart does not reserve it.

If a product becomes unavailable after an order is submitted, we may reject the order before contract acceptance or cancel the affected part of the order where legally permitted. Any payment collected for an unavailable product will be refunded.

7. Ordering Process

Customers may select products, choose available options, add products to the cart, and proceed to checkout.

Before submitting an order, customers can review and correct:

  • Selected products;
  • Quantities;
  • Sizes;
  • Colours;
  • Billing information;
  • Shipping information;
  • Payment information;
  • Delivery method.

By activating the final order button, the customer submits a binding offer to purchase the products in the order.

8. Contract Formation

The product presentation on the website does not, by itself, constitute a legally binding offer.

After an order is submitted, the customer may receive an automated email confirming that the order was received. Unless expressly stated otherwise, this receipt confirmation does not by itself constitute acceptance.

A purchase contract is formed when staudj.shop:

  • Sends an express acceptance or dispatch confirmation;
  • Dispatches the products; or
  • Otherwise clearly confirms acceptance of the order.

staudj.shop may reject an order before acceptance, particularly where:

  • A product is unavailable;
  • Payment is not authorised;
  • Order information is incomplete;
  • There is a reasonable suspicion of fraud;
  • An obvious pricing or technical error occurred;
  • Delivery to the stated address is unavailable;
  • The order would violate applicable law.

9. Contract Language and Storage

The contract language is English unless another language is expressly offered.

Order information and these Terms may be provided electronically.

Customers should save or print the order confirmation and applicable policies for their records.

Where a customer account is available, certain order information may also be accessible through the account.

10. Prices

Prices displayed on the website apply at the time the order is submitted.

Prices include value-added tax where legally required and unless clearly stated otherwise.

Free standard shipping is offered for eligible orders.

Any additional charge must be displayed before the customer submits the order.

Obvious pricing errors do not create an obligation to sell a product at an incorrect price where the error was recognisable or the contract has not yet been accepted.

11. Payment

Available payment methods are displayed at checkout.

Payment may be processed by Shopify or an independent payment provider.

Depending on the payment method, the customer may be redirected to a payment provider or asked to complete additional authentication.

Payment is due in accordance with the conditions displayed during checkout.

The customer must ensure that sufficient funds or credit are available and that the payment information is accurate.

12. Fraud and Payment Verification

Orders may be reviewed for fraud prevention and security purposes.

We may request reasonable additional verification where:

  • Billing and shipping information do not match;
  • The payment provider reports elevated risk;
  • An unusually high-value order is placed;
  • Multiple payment attempts occur;
  • There are signs of identity or payment misuse.

An order may be delayed or rejected before acceptance if verification cannot be completed.

13. Delivery

All eligible orders receive free standard shipping.

The estimated delivery period is normally 15 to 20 days, subject to the Shipping Policy.

Delivery estimates are not guaranteed fixed dates unless a specific binding delivery date has been expressly agreed.

14. Delivery Address

The customer is responsible for providing a complete and accurate delivery address.

Customers should review:

  • Recipient name;
  • Street and house number;
  • Apartment or unit number;
  • Postal code;
  • City;
  • Country;
  • Telephone number.

Address changes cannot always be made after processing or dispatch begins.

Additional costs caused by an incorrect or incomplete address may be charged only where legally permitted.

15. Transfer of Risk

For consumer purchases, the risk of accidental loss or damage generally transfers to the customer when the customer or a designated third party other than the carrier receives the products.

This does not apply where the customer independently commissions a carrier that was not offered by the seller, to the extent provided by applicable law.

16. Retention of Title

Products remain the property of the seller until the purchase price has been paid in full.

17. Right of Withdrawal

Consumers generally have a statutory 14-day right of withdrawal for eligible distance sales contracts.

The conditions, procedure, return deadline, return costs, refund process, exceptions, and model withdrawal form are provided in the Return and Refund Policy.

18. Returns and Refunds

Returns and refunds are governed by the Return and Refund Policy.

Customers must not send products to an unconfirmed address.

Nothing in the Return and Refund Policy limits mandatory statutory consumer rights.

19. Defective or Non-Conforming Products

Statutory rights relating to defective or non-conforming products apply.

Customers should contact info@staudj.shop and provide the order number and a description of the issue.

Depending on applicable law and the circumstances, remedies may include repair, replacement, price reduction, withdrawal from the contract, or damages.

20. Promotions and Discount Codes

Promotions and discount codes may be subject to specific conditions.

Unless otherwise stated:

  • Codes cannot be exchanged for cash;
  • Codes may be limited to one use per order;
  • Codes may not be combined;
  • Codes may have an expiry date;
  • Codes may apply only to selected products;
  • Codes may exclude shipping, gift cards, or previous purchases;
  • Codes may be cancelled where obtained or used fraudulently.

Promotional conditions will not limit mandatory consumer rights.

21. Customer Accounts

Customers may be permitted to create an account.

Customers are responsible for:

  • Providing accurate information;
  • Maintaining password confidentiality;
  • Restricting access to their device;
  • Promptly reporting suspected unauthorised use.

We may suspend an account where reasonably necessary to prevent fraud, security threats, unlawful activity, or serious violations of these Terms.

22. Acceptable Website Use

Users must not:

  • Use the website for unlawful purposes;
  • Attempt unauthorised access;
  • Introduce malware or harmful code;
  • Interfere with website security;
  • Scrape data through prohibited automated means;
  • Misrepresent identity;
  • Place fraudulent orders;
  • Abuse promotions or refund procedures;
  • Infringe intellectual property rights;
  • Use the website in a manner that harms other users.

23. Intellectual Property

The website and its contents may include protected:

  • Text;
  • Product descriptions;
  • Photographs;
  • Graphics;
  • Logos;
  • Layouts;
  • Software;
  • Videos;
  • Designs;
  • Trademarks.

Protected material may not be copied, reproduced, distributed, modified, republished, or commercially exploited without permission, except where permitted by law.

24. Third-Party Services

The website may use or link to third-party services, including:

  • Shopify;
  • Payment providers;
  • Shipping providers;
  • Social media services;
  • Analytics services;
  • Advertising services.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for independent third-party services except where liability cannot legally be excluded.

25. Website Availability

We aim to keep the website available but do not guarantee uninterrupted operation.

Access may be interrupted for:

  • Maintenance;
  • Security updates;
  • Technical failures;
  • Network outages;
  • Provider outages;
  • Events outside our reasonable control.

Temporary website interruption does not affect rights arising from an already accepted order.

26. Liability

Liability is governed by applicable law.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability for:

  • Intentional misconduct;
  • Gross negligence;
  • Injury to life, body, or health;
  • Fraudulent concealment;
  • Breach of an expressly assumed guarantee;
  • Mandatory product liability;
  • Mandatory consumer rights.

For other loss, liability applies in accordance with statutory law.

27. Events Outside Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, subject to mandatory legal rights.

Such events may include:

  • Natural disasters;
  • Severe weather;
  • Epidemics;
  • War or civil disturbance;
  • Government restrictions;
  • Customs disruption;
  • Carrier network failure;
  • Labour disputes;
  • Power outages;
  • Telecommunications failures;
  • Cybersecurity incidents affecting third-party infrastructure.

If such an event materially affects an order, we will take reasonable steps to inform the customer and fulfil, reschedule, or refund the order as required by law.

28. Personal Data

Personal data are processed in accordance with the Privacy Policy and applicable data protection law.

29. Consumer Dispute Resolution

staudj.shop seeks to resolve complaints directly through customer service.

Unless legally required in an individual case, staudj.shop is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration or conciliation body.

Customers may contact:

info@staudj.shop

The former European Union Online Dispute Resolution platform is no longer operational and is therefore not referenced in these Terms.

30. Governing Law

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not deprive the consumer of mandatory protections granted by the law of the country in which the consumer has their habitual residence where those protections apply.

31. Jurisdiction

Statutory jurisdiction rules apply.

A consumer may bring proceedings before the courts available under applicable consumer protection and procedural law.

32. Severability

If an individual provision of these Terms is invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

The invalid provision will be replaced by the applicable statutory rule rather than by a provision that disadvantages the consumer.

33. Amendments

We may update these Terms for future website use and future orders.

The version applicable to an order is generally the version presented when the order is submitted, unless a change is required by mandatory law or expressly agreed with the customer.
